Shillong (Meghalaya), Aug 4: The Meghalaya High Court has condoned a 46-day delay in filing an appeal related to the cancellation of a tender for a project made by M/s Meghalaya Roofing. The court, composed of Chief Justice I.P. Mukerji and Justice W. Diengdoh, allowed the application under Section 5 of the Limitation Act, 1963, and directed the Registry to register the appeal.
The court’s decision came after hearing arguments from both sides, with the respondent-State’s counsel submitting that the delay had not been adequately explained. However, the court noted that three other appeals on identical issues were already admitted and posted for hearing on Aug 8, Given the similarity in issues and the relatively short delay, the court deemed it fit to hear the appeal on merits along with the connected cases.
The court emphasized the importance of transparency and directed that any media reporting this judgment must mention the composition of the bench, including the names of the judges. The appeal will be heard on the existing papers along with the other connected appeals on Friday, Aug 8.
